A simple guide to the CARES Act and its Effect on Unemployment Benefits

It is no secret Americans are dealing with some of the harshest economic conditions since the Great Recession. In terms of how many people have been laid off to date, American hasn’t seen these types of numbers in almost 100 years. Hoping to provide some relief, Congress passed two bills: the Families First Coronavirus Response Act, known as the FFCRA, and the Coronavirus Aid, Relief, and Economic Security Act, otherwise known as the CARES Act. The two pieces of legislation contain a multitude of provisions, but I will be focusing on the provisions that affect the average unemployed American who is searching for support during this unprecedented time. For more information about the Families First Coronavirus Response Act, it was covered by the firm in an article earlier this year here. Since then, the Department of Labor has provided a handy summary that is to be posted in the workplace for the sake of educating employees: read the summary here.

Should teams and employers be allowed to require their athletes to waive HIPPA rights?

Athletes usually sign their health privacy rights away to have disclosed all such health care information to their employer, but even the team's trainer and physician may not be obligated to HIPAA even without such waiver under exceptions of HIPAA.

The coronavirus pandemic, more commonly known as COVID-19, is changing how businesses and customers interact. COVID-19 is highly infectious, and for some, can cause severe health issues or even death. Essential businesses have taken steps to increase customer safety, such as imposing social distancing rules and requiring customers to wear masks before entering their institutions. Although such cautious steps can greatly help reduce the spread of COVID-19, it is not a guarantee of completely preventing the spread of COVID-19. Asymptomatic persons can easily spread the disease, making COVID-19 a particularly insidious virus. Service industries—where social distancing, or even mask wearing, will impede on businesses providing services to customers—could possibly bear a sizable risk of liability for COVID-19 claims.

According to the ADA, people are not required to disclose their medical conditions in order to enter an establishment. But do these guidelines supercede mask requirements for employees or customers? No, because according to the EEOC, COVID-19 meets the "direct threat standard." The Americans with Disabilities Act does not require businesses to allow those not wearing masks to enter during the pandemic. This especially is true in states under mandatory mask requirements. These “mask exempt” cards are not accurate and no place of business is required to accept it. In fact, the ADA has put out information about it being fake and not associated with them. ADA Information on Fake Mask Exempt Flyers and Cards Most businesses will be happy to accommodate those who choose not to wear masks by offering curbside pickup products requested.

Governor Greg Abbott today issued an Executive Order to ensure hospital bed availability for COVID-19 patients as Texas faces an increase in COVID-19 cases and hospitalizations. The Governor’s order suspends elective surgeries at hospitals in Bexar, Dallas, Harris, and Travis counties. Under this order, the Governor directs all hospitals in these counties to postpone all surgeries and procedures that are not immediately, medically necessary to correct a serious medical condition or to preserve the life of a patient who without immediate performance of the surgery or procedure would be at risk for serious adverse medical consequences or death, as determined by the patient’s physician.
