Most of the time when attorneys refer to the “grey” area of the law, they are referring to law that they haven’t spent the time to research and see the black and white. The law is mostly predictable. There are very few grey areas, and where it is grey, their is still predictability as to what is uncertain. For example, the legalization of medical marijuana in certain states is in direct conflict with Federal law. Some attorneys may say that it is a grey area as to the legality of it; however, what is black and white is that their is risk involved that the Federal government could begin enforcing such laws in states that have legalized its medical use and therefore, that risk analysis can be made.
